Conditions of Auction Sale

The following Conditions of Auction Sale apply exclusively for any method of bidding. By bidding in person, in writing or by telephone in any auction, the Bidder acknowledges to be bound by the following terms and conditions:

1. The auction is public and voluntary. All bidding will be in Euro (€), exclusively in the name and for the account of third parties, cash payment being due immediately A sale contract is made directly between the Consignor (Seller) and the Buyer (highest bidder) upon the fall of the hammer. Upon demand of either party, the Auctioneer is legally obliged to name the Buyer and the Consignor. The Auctioneer is under no obligation to accept payment by cheque or by bills of exchange; cheques and bills of exchange may only be accepted on account of performance, and any applicable bank charges are borne by the Buyer.  Generally, there will be no deferral of payment. In exceptional circumstances, individual agreements may be possible provided these are negotiated prior to the start of the auction.

2. The Auctioneer is entitled to enforce all rights of the Consignor relating to the Consignee’s consignments and the sale in the Auctioneer's own name. Commission agents and other persons placing bids on behalf of third parties will be held liable as principle debtors together with the third party if they do not disclose in writing their legal position and authorization upon demand prior to the auction. Any lots bought are sent by mail at the recipient’s expense and risk. The Auctioneer is entitled to exclude persons from the auctions without giving any reasons.

3. The sale will be made to the highest bidder. The Auctioneer, in consideration of the Consignee’s best interest, reserves the right to refuse the knockdown, to withdraw lots, and under special circumstances to re-group lots. The bidding increments (subject to change) are as follows: up to 100,- € = 5,- € / above 100,- € = 10,- € / above 500,- € = 20,- € / above 1000,- € = 50,- € / above 2000,- € = 100,- € / above 5000,- € = 200,- € / above 10000,- € = 500,- €. In case of bids of equal value, the order in which they were received decides. In case of misunderstandings the Auctioneer has the discretion to reoffer the lot.
In relation to the live bidding offered online by the auction house, online auction participants’ possibilities of using are limited from the outset to the current technical equipment of the auction house, which is renewed at irregular intervals. In particular, the technical liability of the Auction House for technical reasons, as set forth in the tender description of the Live Bid and under this policy, shall apply to any disadvantages suffered by an Auction Participant as a result of a technically caused disruption or aggravation of the Live Bid based on lacking hardware and / or software compatibility between auctioneer and auction participant.
A buyer’s premium of 20 % plus 1,50 € per lot will be added to the hammer price. Any Value Added Tax (currently 19 %) due is charged additionally to the buyer's premium, to any other services (expenses) and the hammer price (currently 19 %), and will be separately invoiced. Any lot which is marked in the catalogue by a cross "(x)" not only the buyer's premium but also the hammer price is subject to Value Added Tax at currently 19 %. The VAT may not be due if the purchased lot is exported and the respective tax pre-conditions have been met. A delivery free of VAT into another EU member state is only possible if the Consignor and the Buyer are businesses within the meaning of Section 2 Value Added Tax Act (UStG) and the value added tax identification number has been made available. Any lot marked by a cricle "(?)", the hammer price is subject to import tax at currently 7 % (non-deductible) if the Buyer is residing within the European Union. Buyers residing outside the European Union will not be charged import tax if evidence for the export of the purchased lots is provided.

4. Knockdown constitutes a binding sale, with it the risk passes to the Buyer; title on the other hand will not pass until full payment has been received. The auction invoice will be due immediately from those bidders personally present at the auction, and upon receipt of the invoice from absentee bidders. Buyers not personally known to us will receive a proforma invoice. If a Buyer is in default of payment, default interest at a minimum of 5 percentage points above base rate is charged; the auctioneer reserves the right to charge higher interest provided the auctioneer can prove such interest rate applies, unless the Buyer can prove a lower interest rate applies. In case of non-collection of purchased goods or non-payment, the Auctioneer may exercise its statutory rights; if the Auctioneer claims compensation, this will amount to 25 % of the hammer price as compensation for lost commission, buyer's premium and other expenses unless the Buyer can prove that the auctioneer's damages were lower. This does not prejudice the Auctioneer's right to claim a higher compensation. Any complaints will have to be made within 10 days of the handover or delivery, respectively, of the lot. Any lots objected to have to be returned in their original condition and with their original lot card. Affixation of examination marks by recognised experts of the BPP or any other certification organisation pre-agreed to by the Auctioneer will not be considered a deviation from the original condition. In exceptional cases and if preagreed with the Auctioneer, the deadline for complaints may be extended by the Auctioneer. The obligation to make payment shall not be affected. In cases of justified complaints, the Buyer shall receive a full refund of the sale price, provided the lot in question is returned. Any further claims are precluded. Lots bought by giving incorrect lot numbers cannot be returned.

5. Any items offered at auction may be viewed and examined prior to the auction. The lots are described with the utmost care; such descriptions, however, do not guarantee or warrant a certain condition. The Auctioneer shall not be liable for any faults inherent in the lot, but shall inform the Consignor of notices of defect if received in time. Floor bidders on principle buy "as seen". Errors arising from the illustrations (stamps, edges, perforation etc.) do not constitute a reason to refuse an item. The Buyer shall have no right to reject lots consisting of collections, accumulations or remainder or lots bought through bids below the reserve price. An individual lot consisting of more than three stamps cannot be returned because of small imperfections to individual stamps. The cost of any examinations initiated by the Buyer after the sale will not be reimbursed. Any claims for damage against the Auctioneer, be it for reasons of delay, impossibility to complete, positive breach of contract, fault in conclusion of a contract or in tort, shall be excluded unless such damage was caused by intentional or grossly negligent acts.

6. The Auctioneer may collect the purchase price and other charges and commence legal proceedings in the Auctioneer's own name. The Buyer has no right of disposal for non-cash purchases made at the auction, in particular with regard to disposal by resale or otherwise, until full payment of the auction invoice has been received. The Auctioneer reserves the right to claim back any items which have not been paid or not been paid in full, respectively, in original condition and with the original lot card, for example where pre-agreed extended payment terms have been exceeded. If acceptance of a lot is declined without legal justification, the stamps in question will be resold by auction or private sale at the Buyer’s expense. In either case, the Buyer will remain liable towards the Auctioneer for any loss of profit and towards the Consignor for any shortfall. The defaulting Buyer has no claim on any surplus earned by a possibly higher sales price achieved.

7. Bids made in writing will be diligently and discretionary executed.. Bids marked „best“, „in any case“ do not carry an absolute right to knockdown. Knockdown is not given on the basis of the highest price bid, but in accordance with the bidding increments. In case of „highest bid“, „best“, „absolutely“ etc. bids will be executed up to five times the value of the opening price. The minimum bid for any lot without reserve ("Gebotslos") is 10,- €. Up to 100,- € it will be knocked down at the highest bid, and above 100,- € it will be discretionary knocked down in accordance with the bidding increments.

8. Consignments on approval may be requested upon receipt of the catalogue for the account and at the risk of the recipient, provided that the recipient guarantees the return of the consignment within 24 hours. In case of a late return, the recipient shall be liable to the full extent of the knockdown price achieved. Lot consisting of mint stamps as well as collections and large lots will not be sent out for viewing. Customers not known to the Auctioneer may be asked to name verifiable references. By bidding at auction or by issuing a purchase order bidders are bound by the Conditions of Sale. These are also accordingly applicable to any business activity entered into with the auction lot outside of the auction.

9. Any claims of any kind against either the Consignor or the Auctioneer shall expire no later than one year after the auction.

10. Place of execution and jurisdiction for all purposes of commercial transaction is exclusively Berlin. German law applies. The regulations of the standard (international) purchasing law do not apply. Should any individual provisions of these conditions become entirely or partly invalid, this shall not impair the validity of the remaining provisions.

Für die Verarbeitung Ihrer Daten verantwortlich ist die SCHLEGEL Berliner Auktionshaus für Philatelie GmbH, eingetragen im Handelsregister des AG Berlin-Charlottenburg unter HRB 10781, ges. vertreten d.d. 2.      Erhebung und Speicherung personenbezogener Daten sowie Art und Zweck und deren Verwendung
Wenn Sie uns mit der Versteigerung oder dem Verkauf von Sachen beauftragen, an einer von uns veranstalteten Auktion teilnehmen oder unsere sonstigen Dienstleistungen in Anspruch nehmen, erheben wir folgende Informationen:
·         Anrede, Titel, Vorname, Nachname,
·         ggfs. Firma/Unternehmensbezeichnung,
·         gültige E-Mail-Adresse,
·         Anschrift,
·         Telefonnummer (Festnetz und/oder Mobilfunk),
  • ggfs. Umsatzsteueridentifikationsnummer,
  • Informationen, die für die Auftragsbearbeitung, u.a. also die Erbringung von Versteigerungs-, Beratungs- oder Vermittlungsleistungen oder den Verkauf oder Ankauf von Waren im Rahmen des mit Ihnen abgeschlossenen Vertrags erforderlich sind.
Die Erhebung dieser Daten erfolgt,
·         um Sie als unseren Kunden bzw. von dem Kunden benannten Ansprechpartner identifizieren zu können;
·         um Sie angemessen beraten zu können;
·         für die Korrespondenz mit Ihnen;
·         für die Zusendung von interessenbezogener Informationen, wie etwa Kundenrundschreiben;
·         zur Rechnungsstellung einschließlich unserer Buchhaltung;
  • zur Abwicklung von evtl. vorliegenden Gewährleistungs- oder Haftungsansprüchen sowie zur Geltendmachung etwaiger Ansprüche gegen Sie oder Dritte, z.B. Erwerber im Rahmen der Auktion.
Ohne die Bereitstellung personenbezogener Daten, insbesondere Name und Kontaktdaten sowie der relevanten vertragsbezogenen Informationen, können Sie uns nicht beauftragen bzw. unsere Dienstleistungen nicht in Anspruch nehmen.
Die Datenverarbeitung erfolgt auf Ihre Anfrage hin und ist nach Art. 6 Abs. 1 S. 1 lit. b DSGVO zu den genannten Zwecken für die angemessene Bearbeitung des Auftrags und für die beidseitige Erfüllung von Verpflichtungen aus dem mit Ihnen abgeschlossenen Vertrag erforderlich.
Die zu den genannten Zwecken von uns erhobenen personenbezogenen Daten werden bis zum Ablauf der gesetzlichen, insbesondere handelsrechtlichen und steuerrechtlichen Aufbewahrungspflichten (u.a. aus HGB, StGB oder AO) gem. Artikel 6 Abs. 1 S. 1 lit. c DSGVO gespeichert und danach gelöscht, es sei denn, dass eine längere Speicherung im Einzelfall zur Anspruchsverfolgung, Prüfung, Abwicklung oder Abwehr von Haftungsansprüchen erforderlich und somit gem. Art. 6 Abs.1 lit. f DSGVO gestattet ist, oder Sie in eine darüber hinausgehende Speicherung nach Art. 6 Abs. 1 S. 1 lit. a DSGVO eingewilligt haben.
Sofern personenbezogene Daten von den vorgenannten Fristen nicht betroffen sind, werden sie gelöscht, wenn die Zwecke, für die sie erhoben wurden, entfallen sind.
3.      Weitergabe von Daten an Dritte
Eine Übermittlung Ihrer persönlichen Daten an Dritte zu anderen als den im Folgenden aufgeführten Zwecken findet nicht statt.
Soweit dies nach Art. 6 Abs. 1 S. 1 lit. b DSGVO für die Erfüllung unserer vertraglichen Verpflichtungen oder Abwicklung des Vertragsverhältnisses mit Ihnen erforderlich ist, werden wir Ihre personenbezogenen Daten an Dritte weitergeben.
Wir behalten uns vertraglich das Recht vor, fachlich qualifizierte Dritte mit Leistungen im Zusammenhang mit Organisation und Durchführung von Versteigerungsleistungen und deren Abrechnung unterzubeauftragen. Darüber hinaus kann eine Weitergabe auch an sonstige in die Vertragserfüllung eingebundene Dritte erfolgen. Die weitergegebenen Daten dürfen von dem jeweiligen Dritten ausschließlich zu den in Ziffer 2 genannten Zwecken verwendet werden.
4.      Betroffenenrechte
Sie haben das Recht:
·         gem. Art. 7 Abs. 3 DSGVO Ihre einmal erteilte Einwilligung jederzeit gegenüber uns zu widerrufen. Dies hat zur Folge, dass wir die Datenverarbeitung, die auf dieser Einwilligung beruhte, für die Zukunft nicht mehr fortführen dürfen;
·         gem. Art. 15 DSGVO Auskunft über Ihre von uns verarbeiteten personenbezogenen Daten zu verlangen. Insbesondere können Sie Auskunft über die Verarbeitungszwecke, die Kategorie der personenbezogenen Daten, die Kategorien von Empfängern, gegenüber denen Ihre Daten offengelegt wurden oder werden, die geplante Speicherdauer, das Bestehen eines Rechts auf Berichtigung, Löschung, Einschränkung der Verarbeitung oder Widerspruch, das Bestehen eines Beschwerderechts, die Herkunft ihrer Daten, sofern diese nicht bei uns erhoben wurden, sowie über das Bestehen einer automatisierten Entscheidungsfindung einschließlich Profiling und ggf. aussagekräftigen Informationen zu deren Einzelheiten verlangen;
·         gem. Art. 16 DSGVO unverzüglich die Berichtigung unrichtiger oder Vervollständigung Ihrer bei uns gespeicherten personenbezogenen Daten zu verlangen;
·         gem. Art. 17 DSGVO die Löschung Ihrer bei uns gespeicherten personenbezogenen Daten zu verlangen, soweit nicht die Verarbeitung zur Ausübung des Rechts auf freie Meinungsäußerung und Information, zur Erfüllung einer rechtlichen Verpflichtung, aus Gründen des öffentlichen Interesses oder zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen erforderlich ist;
·         gem. Art. 18 DSGVO die Einschränkung der Verarbeitung Ihrer personenbezogenen Daten zu verlangen, soweit die Richtigkeit der Daten von Ihnen bestritten wird, die Verarbeitung unrechtmäßig ist, Sie aber deren Löschung ablehnen und wir die Daten nicht mehr benötigen, Sie jedoch diese zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen benötigen oder Sie gem. Art. 21 DSGVO Widerspruch gegen die Verarbeitung eingelegt haben;
·         gem. Art. 20 DSGVO Ihre personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesebaren Format zu erhalten oder die Übermittlung an einen anderen Verantwortlichen zu verlangen und
·         gem. Art. 77 DSGVO sich bei einer Aufsichtsbehörde zu beschweren. In der Regel können Sie sich hierfür an die Aufsichtsbehörde Ihres üblichen Aufenthaltsortes oder Arbeitsplatzes oder unseres Kanzleisitzes wenden.
5.      Widerspruchsrecht
Sofern Ihre personenbezogenen Daten auf Grundlage von berechtigten Interessen gem. Art. 6 Abs. 1 S. 1 lit. f DSGVO verarbeitet werden, haben Sie das Recht, gem. Art. 21 DSGVO Widerspruch gegen die Verarbeitung Ihrer personenbezogenen Daten einzulegen, soweit dafür Gründe vorliegen, die sich aus Ihrer besonderen Situation ergeben.
Wenn wir personenbezogene Daten für Direktwerbung verwenden, dürfen Sie jederzeit Widerspruch gegen die Verarbeitung Ihrer personenbezogenen Daten für diese Zwecke einlegen. Nach Eingang Ihres Widerspruchs werden wir Ihre personenbezogenen Daten nicht mehr für diese Zwecke verarbeiten.

The portal www.philasearch.com provides users with the ablility to make orders and place bids auctions with our trade partners through the internet. If you are interested in this option, you will have to complete a special registration first for each particular auction at PhilaSearch. The registration is subject to the following terms and conditions.

 


By clicking the checkbox at the end of the terms and conditions you accept the following conditions and you conclude a contract with PhilaSearch.com GmbH, Lindenweg 1, 63877 Sailauf for the use of the Philasearch.com website.


You can terminate your licence agreement and the subsequent conditions of participation in writing within two weeks of accepting the agreement . Contact Philasearch.com GmbH, Lindenweg 1, 63877 Sailauf or send an e-mail to the following address service@philasearch.com. However, the right of termination is invalidated as soon as you have place a bid on an auction. Apart from that you can terminate the licence agreement at anytime by sending a written statement to the above referenced address. Comments, questions or complaints can also be sent to the above address.

 

Conditions of participation:


I. General methods of use


1. PhilaSearch allows the registered internet user (named "User") to bid In the auctions of the PhilaSearch trade partners before and during the current auction through the internet. Insofar PhilaSearch acts merely as a carrier and not as a representative or agent for the user. In this respect it is clarified that in the case of a successful bid a contract is exclusively made between the user and the trade partner of PhilaSearch, based on the particular auction conditions of the PhilaSearchtrade partner. The respective auction conditions of the trade partner are shown during completing the special registration process and have to be accepted explicitly by the user in order to successfully complete the special registration.

 


2. Registered users of PhilaSearch can only use the PhilaSearch web page within the current standard of technology. Technical disorders or failure of the power supply, transmission networks, hardwareand software faults, bottlenecks in capacity, safety or service interruptions can affect the utilizationand access of the service. The quickness of the data transmission is dependant on the existing hardware and internet connection of the user. PhilaSearch assumes no liability for a bid arriving in time to the auctioneer.


3. The use of the PhilaSearch services is free for registered users.
 

 

II. Registration, Personal data


1. A user has to complete a form to be registered. The user has to provide all of the requested data/information completely and correctly. This includes first and last name, current address and telephone number, a valid e-mail addressand if applicable, company. If the requested changes after registration the user is required to submit the edits immediately to PhilaSearch.

 


2. The user must state the necessary registration data truthfully. PhilaSearch reserves the right to prohibit users, whose data is incorrect or obviously wrong, as well as users, which have submitted a registration by bypassing the form.


3.Philasearch will relay the personal data provided in the registration form to the particular trade partner who is performing the auction for which the user has registered. The PhilaSearch trade partner has the right to reject any registration submitted via PhilaSearch without a specification of reasons. In the case of rejection, PhilaSearch will delete the registration and inform the user via the e-mail address, provided during the registration.


4. The registration is followed by a confirmation process through PhilaSearch A confirmation code will be sent to the e-mail address of the user.


5. A registration at PhilaSearch is only valid for one auction. If a user wants to participate in additional auctions, a new registration is needed. Once the registration is complete and initialised the user can place bids.
 

III. Copyright, Images


1. All information and images on this portal and the auctions included are copyright-protected property of their respective creators.

2. It is not permitted to download, copy or make use of the aforementioned assets in any way.

 

 

IV. Warranty and liability


1. As there is no contract between PhilaSearch and the user for bids onauctions of PhilaSearch trade partners, PhilaSearch again indicates explicitly that PhilaSearch assumes no liability for the accuracy and completeness of the data provided with the offered articles of PhilaSearch trade partners.

 

 

V. Other


1. The present business conditions including the licence agreement are subject to the laws of the Federal Republic of Germany and without possibility of recourse, the UN-consumer rights laws, as far as the user is an entrepreneur. If the user is a consumer, the business conditions including the licence agreement are subject to the laws of the Federal Republic of Germany, especially consumer protection regulations.

 


2. In the event that one of the above terms and conditions is effectless, due to a conflicting law or regulation, the remaining terms and conditions will remain valid.
